29 CFR 1910.1053(f)(1):The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible. a) On or about December 02, 2020, at the Aggregate Filler Machine, employees (Forklift Operator/Laborer) were exposed to airborne Crystalline Silica in concentration of 149 mcg/m3 while filling bags of gravel/sand/pebbles aggregate and stacking bags on a pallet without having adequate Engineering Controls established throughout facility to reduce the Silica exposure to below the PEL. b) On or about December 02, 2020, at the Aggregate Filler Machine, employees (Laborer) were exposed to airborne Crystalline Silica in concentrations of 176.3mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet without having adequate Engineering Controls established throughout the facility to reduce the Silica exposure to below the PEL. c) On or about December 02, 2020, at the Aggregate Filler machine, employees (QC/Laborer) were exposed to airborne Crystalline Silica in concentrations of 75.2mcg/m3 while filling bags of gravel/sand/pebbles and stacking bags on a pallet without having adequate Engineering Controls established throughout facility to reduce the Silica exposure to below the PEL.
