29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Fairhaven Christian Retirement Center located at 3470 N. Alpine Road, Rockford, Illinois: On or about November 18, 2020 through December 29, 2020, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear KN95 filtering facepiece respirators throughout their shifts while employees were performing duties such as administering medication to residents, orally or intravenously, assisting with bathing, feeding, or dressing, on suspected or confirmed positive COVID-19 residents. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
