29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) JBC Ent., Inc., at 3319 N Clayton Street, Denver, CO: On 11/25/2020 the employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards. An employee used an excavator to tear down the concrete walls of an approximately twelve foot deep basement. Following this, the north wall and significant sections of the east and west walls were removed and unsupported vertical earth was exposed. The supporting structure for a metal and concrete stairway was undermined during the demolition of the concrete wall in the northeast corner. The stairway collapsed into the excavation. An employee working in proximity to the stairway also fell into the excavation. The employee died as a result of injuries sustained in the fall. The employee had not received effective training regarding fall hazards. This condition exposed the employee to an approximate 12 foot fall hazard.
