29 CFR 1917.50(c)(5)(i):Special stevedoring gear provided by the employer (with a SWL greater than 5 short tons, the strength of which depends upon components other than those commonly used stock items such as shackles, ropes or chains) was not inspected and tested as a unit before initial use. On or about November 24, 2020, the employer did not ensure that cargo handling equipment used to offload 1250 kg bags of sugar from vessels docked at the terminal had been inspected and tested prior to initial use of the equipment exposing employees to potential struck-by hazards.
