29 CFR 1910.134(d)(1)(ii):The employer did not select a NIOSH-certified respirator. The respirator was not used in compliance with the conditions of its certification: a) At the facility, 205 East 1st Street, Corning, N.Y. The employer did not provide NIOSH-certified respirators to employees who were required to care for suspected and confirmed positive COVID-19 residents. The employer provided and required employees to wear respirators labeled "KN95." However, the KN95s did not contain certification markings indicating they were certified under an equivalent international standard. The violation occurred on or about 12/20/2020 through 01/07/2021.
