29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Alameda Center for Nursing and Rehabilitation, located at 303 Elm Street, Perth Amboy, NJ: On or about 4/23/2020 and continuing thereafter, Certified Nursing Assistants were required to wear N95 respirators when providing direct care to suspected or confirmed COVID-19 positive residents. Employees required to wear N95 respirators were not provided medical evaluation before being required to use the respirator.
