29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) 2509 South Fourth Operating, LLC, d/b/a St. Monica Center for Rehabilitation and Healthcare located at 2509 South Fourth Street, Philadelphia, PA 19148: On or about June 1, 2020, and thereafter, the employer did not provide a medical evaluation to determine each employee�s ability to use a respirator before requiring the use. The employer required employees, including registered nurses, certified nursing assistants, and licensed practical nurses, to wear N95 respirators, including 3M brand N95 respirators model # 1860, while providing direct patient care to suspected and confirmed COVID-19 positive residents.
