29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: a) At the facility, 1621 Route 22 West Operating Company, LLC, Bound Brook, NJ. The employer did not provide NIOSH-certified respirators to employees who provided care and services to suspected and confirmed positive COVID-19 patients. The employer provided and required employees including, but not limited to Registered Nurses, Certified Nursing Assistants, Licensed Practical Nurses, and Housekeeping staff to wear respirators labeled KN95. However, the KN95 respirators were not used in compliance with the conditions of their certification in that they were not appropriately fit tested on employees. Violation occurred on or about on 5/09/2020, and thereafter. ABATEMENT DOCUMENTATION REQUIRED
