29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: a) Patient Care: The employer did not provide NIOSH-certified respirators to employees who were required to work with confirmed and suspect COVID19 residents. Employees were provided respirators labeled "KN95" which were not NIOSH certified. The employer required all employees to wear respirators throughout their shifts at work on or about 3/14/2020 and after.
