29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: a. On or about April 23, 2020 and thereafter, at the Long Term Care 4th and 5th floors. The employer did not select and provide a NIOSH-approved respirator to employees, including but not limited to Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs), who provided direct patient care to residents suspected or confirmed to be infected with SARS-CoV-2 coronavirus. The employer required these employees to wear respirators labeled KN95 despite the availability of other alternative NIOSH-approved filtering facepiece respirators. NOTE: Certification of abatement is not required for this citation item as abatement was documented by the compliance safety and health officer during the inspection.
