29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace: a) Hamilton 2 and Madison 2: The employer required the Licensed Practical Nurses (LPNs), a Minimum Data Set (MDS) Coordinator and an Assistant Director of Nursing (ADON) to wear respirators throughout their shifts at work. The employer did not provide a medical evaluation to determine the Licensed Practical Nurses (LPNs), a Minimum Data Set (MDS) Coordinator and an Assistant Director of Nursing's (ADON) ability to use a respirator before the employees were required to use the respirator in the workplace with confirmed positive or suspected COVID-19 residents. This violations occurred on 4/6/2020 and after. b) Hamilton 2 and Madison 2: The employer required all Certified Nursing Assistants to wear respirators throughout their shifts at work. The employer did not provide a medical evaluation to determine the Certified Nursing Assitants ability to use a respirator before the employees were required to use the respirator in the workplace with confirmed positive or suspected COVID-19 residents. This violations occurred on or about 4/6/2020 and after. This instance refers to OSHA inspection#1486514 opened on 8/5/2020.
