29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator: a) Throughout the facility, Innova Gloucester Deptford Bridge Operations LLC in Deptford, NJ. - The Employer provided respirators that were labeled KN95 to employees such as, but not limited to RNs, LPNs, CNAs and housekeeping staff for use when providing care and services to suspect and confirmed positive COVID-19 residents, on or about 4/19/2020 and after. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
