29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Dundee Resort Development, LLC. DBA Arapahoe Basin located at 28194 US Hwy 6 Dillon, CO 80435: On or about 7/20/2020 and at times prior, the employer did not ensure daily inspections of excavations, the adjacent areas, and protective systems were made by a competent person for evidence of possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. Employee(s) were working in a trench that was approximately 4 feet deep that had ground water accumulation. This condition exposed employees to caught-in and cave-in hazards.
