29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Mt. Bethel Management Company, LLC, dba Mt. Bethel Village, 130 Mt. Bethel Rd., Warren, NJ: The employer required employees such as Direct Support Staff to wear N95 respirators without providing medical evaluations prior to the required use of respirators in the workplace.
