29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At Inglemoor Rehabilitation and Care Center of Livingston, on or about April 23, 2020, and thereafter, where the use of respiratory protection, including but not limited to N95 respirators, was required for Registered Nurses (RNs), Licensed Practical Nurses (LPNs), and Certified Nursing Assistants (CNAs) providing direct patient care and housekeeping staff providing support functions to patients, the employer did not ensure that medical evaluations were performed. Abatement certification and documentation is required.
