29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Water's Edge Healthcare & Rehab Center, LLC. - 512 Union Street, Trenton NJ: On or about 05/02/2020 and after, the employer did not provide medical evaluations to determine that employees were medically fit to wear respirators while providing care to COVID-19 positive/suspected patients. Employees were provided with and required to wear respirators such as but not limited to the Gerson 2130 N95, MYKYC 9051A N95, and the 3M N95-8210.
