29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Ivy Hill Rehab LLC, d/b/a AristaCare @ Ivy Hill: On or about May 20, 2020, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer provided and required the nursing staff employees to wear Kimberly Clark or 3M 8510 N95 filtering facepiece respirators while providing care to suspected or confirmed positive COVID-19 residents.
