29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level was protected from falling by a guardrail system, safety net system, travel restraint system or personal fall arrest system: Employees engaged in welding activities at the chemical department were exposed to a fall hazard of approximately 5 feet from the walking-/-working surface of the Genie 2032 scissor lift to the ground below, in that an employee was working above the lift railing system and a fall protection system was not in place.
