29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) On or about April 17, 2020, Greystone Healthcare Management Corp. did not provide a medical evaluation to determine employees ability to use respirators. Employees taking care of residents and assisting residents with activities of daily living in the 1200 and 1300 wings of the facility were required to wear respiratory protection including, but not limited to, 3M 8200, SH9550 N95, SH9550C N95, or SH9550A N95 filtering facepiece respirators.
