29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) 250 Bloomfield Avenue, Bloomfield, NJ. On or about April 23, 2020, and continuing thereafter, the employer did not provide medical evaluations to employees, including Registered Nurses, Licensed Practical Nurses, Certified Nursing Assistants, and Patient Care Assistants, before they were required to wear N95 filtering face piece respirators when working with residents, including those under investigation and/or confirmed as COVID-19 positive.
