29 CFR 1926.1427(c)(1): The employer did not ensure that, prior to operating any equipment covered under subpart CC, the person operating the equipment was licensed by a government entity for operation of the equipment within that entity's jurisdiction: The employer is failing to protect employees from structural collapse or struck-by hazards associated with having an untrained and uncertified operator lifting materials to exposed employees on the tank. This was most recently observed on or about October 14, 2019, at a jobsite located at 900 SW Lower Lake Road, St. Joseph, Missouri. Employees were exposed to overhead hazards and structural collapse hazards due to the operator of the crane was not licensed to operate the crane and was operating the crane in unsafe manners and conditions. The operator, was lifting the crane without proper footings, missing equipment, performing blind lifts, and was being rigged and signaled by untrained, unqualified employees.
