29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) 144 S. Dupont Highway: New Castle, DE - On or about August 22, 2019, the employer failed to ensure employees who are required to wear respirators during the mixing of Portland Cement, were medically evaluated prior to being required to use a respirator in the workplace.
