29 CFR 1910.178(l)(4)(i): Refresher training including an evaluation of the effectiveness of the training, shall be conducted as required by paragraph (l)(4)(ii) to ensure that the operator has the knowledge and skills needed to operate the powered industrial truck safely. On or about August 13, 2019, and at times prior thereto, at the establishment, employees operating powered industrial trucks, such as but not limited to the (Hyster 99-515 Tugger, Type 0120855FB), were not provided with refresher training including an evaluation of the effectiveness of the training, as required by paragraph (l)(4)(ii) to ensure that operators have the knowledge and skills needed to operate the powered industrial truck safely, exposing employees to the hazards of ejection and being struck-by.
