29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (0.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) On or about July 15, 2019, the employer did not ensure that excavated material was kept at least 2 feet from the edge of a trench that was greater than 5 feet deep. This exposed employees to struck-by and cave-in hazards from excavated material such as soil. An employee was completely buried from a partial wall collapse resulting in the employee sustaining a broken jaw, a lacerated left ear, and a right arm deep laceration.
