29 CFR 1915.12(b)(1)(ii): The employer did not ensure that spaces and adjacent spaces that contain or have contained combustible or flammable liquids or gases were tested by a competent person to determine the concentration of flammable vapors and gases within the space prior to entry by an employee. (a) Boat Barn - Fishing Vessel (FV) Progress - On or about February 1st, 2019 and at times prior thereto, employees were exposed to fire and explosion hazards while accessing confined and enclosed spaces including, but not limited to: Fuel Oil Tanks #1 port/starboard, #2 port/starboard, #3 port/starboard, #4 port/starboard and Fish Holds #1-4 without a gas free competent person performing inspections and testing the atmospheres for flammables and combustibles.
