29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a. On or about March 26, 2019, during sampling performed in one shift for 260 minutes in the metal cutting area, a "cutter" was exposed to a noise dose of 186% or an equivalent TWA of 94 dBA, which was capable of causing permanent hearing loss, and the employer failed to develop and implement a monitoring program. b. On or about March 26, 2019, during sampling performed in one shift for 291 minutes in the metal cutting area, a "cutter" that was exposed to a noise dose of 136% or an equivalent TWA of 92 dBA, which was capable of causing permanent hearing loss, and the employer failed to develop and implement a monitoring program. Canyon Commercial Construction, Inc. was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1910.95(d)(1), which was contained in OSHA inspection number1194319, citation number 1, item number 1-b and was affirmed as a final order on 02-17-2017, with respect to a workplace located at 3440 NW 135th St., Opa Locka, FL.
