29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that was 4 feet (1.2 m) or more above a lower level was protected from falling by one or more of the following: Guardrail systems, safety net systems, or personal fall arrest systems: (a) Tank Farm Catwalk - On or about April 16, 2019, workers were exposed to a 9 foot fall from a catwalk which had a guardrail having no midrail on only one side. (b) Tank Farm Platform - On or about April 16, 2019, workers were exposed to a 9 foot fall from a platform having no standard guardrails or other means of fall protection. (c) Mixer Drum (Drier) - On or about April 16, 2019, workers were exposed to 5 foot fall for a 32 inch portion of guardrail was missing on a 6 foot by three foot platform. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet).
