29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103)(a): (a) On or about April 11, 2019 and times prior thereto, the employer did not provide a medical evaluation for employee(s) who were required to wear a 3M half facepiece elastomeric respirators. Employees used this product for protection against chemical inhalation hazards from Sherwin Williams ProMar 200, Sherwin Williams Wood Classic Fast Dry Oil Varnish, Startex Paint Thinner, Sherman Williams PVA Drywall Primer and Sealer when performing painting activities.
