29 CFR 1910.133(a)(3): The employer did not ensure that each affected employee who wears prescription lenses while engaged in operations that involve eye hazards wears eye protection that incorporates the prescription in its design, or wears eye protection that can be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses: A.) Zambelli Fireworks Manufacturing Co., 782 Garner Road, Edinburg, PA 16116, building #29, on or about April 4, 2019 and times prior thereto: An employee was struck-by materials being expelled by a launched firework during the assembly of a firework display. The employee was wearing prescription eyewear that was not ANSI Z87 approved. The employee was also not wearing safety eyewear in conjunction with the prescription eyewear. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
