29 CFR 1910.28(b)(3)(i): The employer did not ensure each employee is protected from falling through any hole (including skylights) that is 4 feet (1.2 m) or more above a lower level by one or more of the following: covers, guardrail systems, travel restraint systems, or personal fall arrest systems, as required by sub-items A through D of this section: a. On or about October 8, 2018, on the 1:12 pitch metal roof employees were walking and working on the roof cleaning gutters, without any fall protection from falling through fiberglass skylight panels flush with the roof, being exposed to 14-foot 10-inch fall hazards. b. On or about October 9, 2018, on the 1:12 pitch metal roof the plant manager and another employee were walking and attaching a piece of corrugated metal roofing to cover the hole in the fiberglass skylight panel where an employee had fallen through without the use of any fall protection systems, being exposed to 14-foot 10-inch fall hazards.
