29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) ColorCoat, Inc./Middlesex, NJ- Throughout the Plant: The employer did not develop and implement monitoring program for employees working in the plant and exposed to noise levels of 92.9 dBA (window cleaner), 91.0 dBA (window cleaner), 88.0 dBA (window cleaner), 92.1 dBA (painter). These levels exceeded OSHA Action Level of 82.7 dBA, which was adjusted based on extended 11 hour work shift. Sampling time was 621 minutes, 621 minutes, 497 minutes, and 621 minutes respectively. Zero exposures were assumed for all unsampled time periods. Condition observed on or about June 5, 2018.
