29 CFR 1910.95(k)(1): The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k) and ensure employee participation in the program. (a) In the engine room of M/V Matanuska, at Vigor Marine, LLC shipyard at 5555 N Channel Ave, Portland, Oregon: On or about 2/7/2018 and at times prior thereto, employees were exposed to sound levels exceeding an 8-hour time-weighted average sound level of 96 decibels measured on the A scale without participating in a noise training program in accordance with the requirements of 29 CFR 1910.95(k)
