OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees On or about January 17, 2018, the employer allowed employees to engage non-essential night-time dock-to-dock towing operations using a 21- foot Privateer tow boat during a Gale Warning issued by the National Weather Service and a declared State of Emergency for a Winter Storm for the entire state and to continue to permit employees to engage in towing operations despite significantly deteriorating and hazardous weather conditions associated with the winter storm.
