29 CFR 1910.178(q)(7): Industrial trucks were being placed in service after the examination showed conditions adversely affecting the safety of the vehicle. On or about October 26, 2017, the REALLIFT Model # CPQD25N-RW26-Y forklift was placed into service despite the daily inspections indicating that the brakes were not functioning properly and that the forklift was leaking oil. For nearly seven weeks, it was documented on the daily examinations that the brakes were defective, yet it continued to be placed into service and operated by employees on a daily basis, thereby exposing them to struck-by hazards.
