Text For Citation: 01 Item/Group: 001B Hazard:
29 CFR 1910.106(e)(6)(ii): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 °F (37.8 °C), were dispensed into containers without the nozzle and container being electrically interconnected: a) Spray paint booth: Category 2 flammable liquids, including, but not limited to, Penn Valley Paints Industrial Lacquer Thinner T-95, Penn Valley Paints Gloss Aluminum Lacquer,and Penn Valley Paints Bronze Lacquer, were transferred into a five gallon mixing container that was not grounded, on or about 9/19/17. b) Spray paint booth: A Binks SV100 Conventional Suction Feed Spray Gun used with category 2 flammable paints and paint thinner was not grounded during use, on or about 9/19/17. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
