29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) On or about September 14th, 2017 and at times prior employees were exposed to a struck-by hazard from overhead soil while installing a water line in a trench approximately nine and a half feet deep where two spoil piles were placed directly on the edge of the excavation in the vicinity of 4099 South ND Highway 3 in Dawson, North Dakota.
