29 CFR 1926.651(i)(2): Excavation below the level of the base or footing of any foundation or retaining wall that could be reasonably expected to pose a hazard to the employees was not prohibited: (a) Banuelos Quality Concrete Corp. at 3137 W. Denver Place, Denver, CO 80211: On and before August 7, 2017, the employer did not prohibit the excavation of soil from going below the level of the base or footing of the existing house foundation. The soil next to the foundation was excavated (sheer cut) to a level of approximately 2-3 feet lower than the foundations base. This condition exposed employees working in the excavation to struck-by hazards when the foundation wall collapsed, resulting in an employee being severely injured.
