29 CFR 1910.134(e)(1): The employer does not provide medical evaluations to determine employees' ability to use a respirator before employees are fit tested or required to use the respirator in the workplace: (a) The employer, Radi's Custom Woodworks, is failing to ensure that each affected employee, who is required to wear 3m 6800 full face tight-fitting respirators while spraying SHER-WOOD Fast Dry Vinyl Sealer, Hi-Bild Lacquer, and paints onto wood products, is provided a medical evaluation prior to respirator use. The following is a recently observed specific example of the employer failing to comply with the cited standard: 1. On or about June 21, 2017, an employee of Radi's Custom Woodworks was observed spraying SHER-WOOD Fast Dry Vinyl Sealer, Hi-Bild Lacquer, and paints onto wood products while wearing a 3m 6800 full face tight-fitting respirator. The employee had not been medically cleared prior to the required respirator use.
