Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by an overturning truck crane and its load. At the jobsite at Schenectady International, an employee was struck by an overturning hydraulic truck crane (Gallion, Model 150EA, Serial #10472). Among other methods, one feasible and acceptable abatement method to correct this hazard is to avoid sudden starts and stops when rotating the crane. The rotational speed shall be such that the load will not swing out beyond the radii at which it can be used when rotation of the load is hazardous as specified by paragraph 15-3.2.3-o of American National Standard, ANSI B30.15.
