29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: Site- The employer did not have a competent person conduct an inspection of the excavation to determine what type of protective system would be required prior to employees entering the excavation. On or about May 16, 2017 employees entered an unprotected excavation to level stone and set a precast concrete drainage header without having a competent person inspect the excavation.
