29 CFR 1910.23(c)(1)(iii): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides (except where there is entrance to a ramp, stairway, or fixed ladder) and the railing was not provided with a toeboard beneath the open sides where there was equipment with which falling materials created a hazard: Establishment: a) Tire Shredder Building - employees on the ground level were exposed to falling tires from an open sided storage rack on the second floor AND; b) Outside Tire Shredder Machine Area - employees on the ground level were exposed to falling objects such as tools where employer did not provide a standard toeboard for the platform adjacent to the tire shredder machine chute that was approximately 112.5 inches above ground level.
