29 CFR 1910.26(c)(2)(vii): Ladders having defects are not marked and taken out of service until repaired. The employer fails to mark ladders with defects and take them out of service. This violation was last observed on November 15, 2016, in the fabrication shop; employees were observed utilizing an aluminum step ladder with missing and bent horizontal supports between the back rails, to access the bed of a knuckle boom truck. To abate this violation, the employer must ensure that all ladders having defects are marked and removed from service until repaired by either the maintenance department or the manufacturer. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a copy of site-specific program detailing the procedures used to ensure compliance and training of employees.
