29 CFR 1910.269(p)(4)(ii): Operations mechanical equipment near energized lines or equipment. A designated employee other than the equipment operator shall observe the approach distance to exposed lines and equipment and give timely warning before the minimum approach distance required by paragraph (p)(4)(i) is reached: Worksite: The employer did not ensure that an employee other that the derrick boom truck operator was selected to act as a "designated employee" to observe the truck operation to insure that the minimum safe approach distance was maintained at all times. On or about 06/09/2016, a portion of the boom of the above truck came in contact with the exposed energized overhead transmission power line, causing an employee working in close proximity of the truck sustaining fatal injuries from electric shocks.
