29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: WORKSITE: The employer did not provide specific training and instructions to employees in the recognition of hazards and the procedures necessary to eliminate or minimize those hazards while performing the tasks, such as (but not limited to) rigging, lifting, unloading and transporting bundles of rebar utilizing slings that were hooked onto teeth of the bucket of an excavator. On or about December 8th, 2015, one of employees was trying to hand-grab the above bundles of rebar (loads) by jumping up and down from underneath the elevated loads that were rigged with slings hooked onto teeth of the bucket of the Kobelco Model SK160LC hydraulic excavator. The slings came off the teeth of the bucket, causing the loads to fall, strike and pin the employee to the ground. The employee sustained fatal head injuries from the incident.
