Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling with an elevator car-sling and platform free falling from upper levels to the elevator pit and/or being struck by a free falling elevator car-sling and platform and/or its components. a)Job Site: 365 Fifth Ave., New York, NY - The employer failed to rope the govenors and make the safeties operational prior to the hoisting of car-slings and platforms which exposed the workers to falls within the elevator of free falls of up to 177-feet to the elevator pit; on or about March 29, 1999. ABATEMENT: Among other methods,one feasible acceptable method to correct this hazard is: 1) Follow the recommended industry practice described in "National Elevator Manufacturing Industry, Inc. manual entitled "Installation Manual, Basic Field Practices for Installation of Elevator and Escalator Equipment", April 1970, page 268 of chapter 9, section C 1, "Before raising the elevator, the govenor rope must be installed and the safety device made operational" and National Elevator Industry Educational Program training module 7, unit 2 "Elevator Rope and Roping which states in pages 18 - 20 "Before you lift the car, ensure the govenor rope is installed and the safety device is operating." ABATEMENT VERIFICATION IS REQUIRED FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $ 1000.00, AS PER 29 CFR 1903.19.
