Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: In that employees were exposed to the hazard of a falling load from the hook of a 2-ton jib boom electric hoist due to missing, defective or oversize safety latches installed on the hoist hooks causing the lifting sling to unload from the hook as the load was lowered to the work surface. Among other methods, one feasible and acceptable method to correct the hazard would be to equip all hoist hooks with the proper size safety latches which shall be replaced when damaged. The above corrections are referenced by ANSI standard B30.16, Overhead Hoists, Para 2.1.2.10.
