Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck due to uncontrolled movement of unit and falling from height of 39 feet: a)Site 65 East 55th Street: Employee was exposed to falling from height of 39 feet due to not being trained in the proper safe operating procedure for the Genie as required in the company manual and ANSI 92.3 1990, on or about 11/27/96. Abatement Note: Among other method, one feasible and accepted method to correct this hazard is to use the Genie as instructed by manufacture and train the employees as required in ANSI A 92.3 1990 Section 8.6.ion
