Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of oxygen deficiency, flammable fumes, dusts or vapors and/ or toxic fumes or vapors in a confined space, in that, on or about 11/21/85, employees was working in #3 grain storage bin without tests having been made to insure the atmosphere was safe. Among other methods, one feasible and acceptable abatement method to correct this hazard is to test the atmosphere in the confined space for oxygen content, flammability, and toxic materials.
