29 CFR 1915.73(d): When employees were exposed to unguarded edges of decks, platforms, flats, and similar flat surfaces, more than 5 feet above a solid surface, the edges were not guarded by adequate guardrails meeting the requirements of 1915.71(j)(1) and (2), unless the nature of the work in progress or the physical conditions prohibit the use or installation of such guardrails: (a) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 31, 2014, employees were laying down tape on an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet resulting in death. (b) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 30, 2014, employees were applying primer to an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet. (c) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 29, 2014, employees were removing non-skid paint on an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet. (d) USS Boxer (LHD-4), Flight Deck Area, Cargo and Weapon's Elevator: On July 22, 2014, two employees were installing plastic containment inside an elevator platform that did not have guardrail protection. Employees were exposed to fall hazards of up to 98 feet.
