29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: On or about June 3, 2014, and at times prior thereto, in the lumber storage building at Ken's Discount Building Materials, located at 1200 North West Avenue in El Dorado, Arkansas, an employee who was not using any form of respiratory protection, was enveloped in dust while repackaging split mortar bags and sweeping spilled mortar mix. The employer neither evaluated the hazard nor provided any type of respiratory protection. These conditions exposed employees to the hazard of inhaling silica dust.
